Sober man's DWI arrest?

  • Man arrested for DWI but no alcohol in system
  • KVUE: Austin PD stands by take-no-chances policy

A man in Texas was pulled over and asked to do a field sobriety test.  He claims he only had one drink. The police arrest him for driving while intoxicated and take him to the station.  When they give him a Breathalyzer test, he blows a 0.00.  But the police hold him for the night in jail anyway.  For what reason?  HLN reached out to the police for a response but did not hear back.

Jane Velez-Mitchell spoke to Larry Davis, the man who blew 0.00 and was still held overnight.
