As the family of a missing Toledo, Ohio baby continues to pray for her return, prosecutors say her case is now a homicide investigation. No charges have been filed yet.
Family members tell HLN affiliate WNWO that the decision came as a surprise.
"They did apologize for the way it happened. I guess maybe if they would have possibly called TJ (Elaina’s father) and said 'Hey. This is what we’re going to do and how we are going to do it.' But for TJ to just have it thrown out there in the court...yeah it was a big blow," Elaina's cousin Ginger Smith told WNWO.
Elaina’s family was in court Wednesday for her mother’s hearing. Angela Steinfurth is charged with obstruction of justice. A judge ruled to delay her hearing.
Elaina has been missing since June 2. Angela’s ex-boyfriend, Steven W. King, is also charged with obstruction of justice.
