Defense: Young trial about 'two innocent victims'

Defense attorney Peter Schuler began his opening statement in Joshua Young's trial by telling jurors that Young and Trey Zwicker were both innocent victims of Joshua Gouker.

A man who pleaded guilty to beating his stepson, 14-year-old Trey Zwicker, to death in May 2011 used the bible to justify his actions in explosive testimony Monday in the Joshua Young trial.


Josh Gouker gave a shocking reason as to why he killed the teenager in cold blood: Because Young's mother, who Gouker was married to at the time, had aborted some of his children.


“His mother killed a couple of mine, and it just felt right. I know it sounds monstrous, and all that [expletive], but it’s not. If we was in the Old Testament, it would be the same thing,” said Gouker, wearing his orange prison jumpsuit.


However, prosecutors say Gouker didn’t kill his stepson alone, and in fact roped Young, his biological son, into his murderous plan. Young is on trial for murder and tampering with evidence for his alleged role in stepbrother, Trey Zwicker's death.


Young looked down during most of Gouker’s testimony Monday, and occasionally whispered to his attorney.


Gouker, who is serving a life sentence for the brutal murder, said he became angry with Zwicker when he noticed the teen had stolen his lighter. So he decided to take Zwicker down to a spot at a nearby creek to scare him.


When Gouker and Zwicker got to the spot by the creek, Zwicker picked up a pipe and hit some trees with it. Gouker said he punched the teenager, and Zwicker fell down on the ground. He then took the pipe out of Zwicker’s hand and began to beat him to death with it. Gouker eventually disposed of the pipe and the clothes he was wearing in a dumpster outside a Mexican restaurant.


Numerous times Gouker became amused with his own lies as prosecutor Erin White pointed out the prior inconsistent statements he told law enforcement. At one point, he appeared to become frustrated with White.


“I know what you are doing. You are trying to make microscopic little holes in this [expletive] that I didn’t give a [expletive] two years ago. So how can I tell you the exact thing now when I really didn’t give a [expletive] then,” said Gouker.


“If you are telling the truth, it shouldn’t be too hard,” said White.


"I’m a [expletive]. Yeah but [expletive]. I have lied this whole [expletive] time except for since arraignment. Since arraignment court, I have done it. I admitted everything I have done. I have been sentenced for it, life in prison. Yet here I am going over the same [expletive] story,” said Gouker.


White accused Gouker of being a mastermind who was able to manipulate the investigators with his lies.


“It’s not easy to be a mastermind when you are dealing with dumb people. I mean that guy couldn’t find [expletive] at a strip club,” said Gouker, apparently referring to an investigator.


Gouker then made another stunning admission: He said he lied to investigators because he wanted to be released from custody so he could kill Zwicker’s mother. Gouker is now divorced from Zwicker's mother, Amanda McFarland.


During cross examination, Gouker said he was able to intimidate and control numerous people to lie on his behalf during the investigation into Zwicker’s death.
