The attorney who represents one of the two defendants charged with raping a girl in Steubenville, Ohio has filed a motion to dismiss the case.
Walter Madison says the trial would violate the due process and equal protection clauses. He expects a hearing on the motion to take place Wednesday.
His client, Ma'Lik Richmond, and Trent Mays are accused of raping a 16-year-old girl who may have been unconscious.
A video posted online the night of the alleged rape shows the star athletes carrying her by her wrists and ankles.
In the days after the alleged assault, the girl discovered obscene pictures and videos of herself online and her parents went to police. The two teens were arrested and are currently under house arrest, awaiting trial.
They'll be tried in juvenile court starting on Wednesday. The judge has ruled that the trial will be open to the media and the public, although many witnesses have declined to be on camera.
