Justice Department brief argues against prop. 8 which bans gay marriage in California

The Obama administration is urging the supreme court to rule in favor of same-sex marriage in California.

The Justice Department said in a brief that proposition 8 should be struck down. You may remember, prop. 8, bans same-sex marriage.

According to a senior official the new brief has personal input from President Obama.

The supreme court is expected to take up the case this month.
