Will Sandusky be able to see his grandchildren?

Judge John Cleland is expected to decide Monday, if Jerry Sandusky will be able to visit with his grandchildren.

The former Penn State assistant football coach is facing 52 counts of child molestation that span a 15 year period. Sandusky has pleaded not guilty to the charges.

At a hearing on Friday, Judge Cleland said he is aiming for Sandusky's trial to begin on May 14.

Sandusky’s attorney Joe Amendola has argued that even incarcerated people have visitation rights.

"11 minor grandchildren ... have expressed their sadness to their parents about not being able to visit or talk," wrote Amendola in court documents.

Prosecutors disagree with Sandusky’s position.

"(Sandusky) was fortunate to be granted house arrest when he is alleged to have committed at least 52 sexual offenses against innocent children," prosecutors said in court motions. "He has been granted the privilege of being confined in his home, which is spacious and private, and where he can eat food of his own preference and sleep in his bed at night."

Sandusky’s former daughter-in-law doesn’t want her children around him. She was granted a protective order preventing him from being around his grandchildren shortly after the scandal broke.

Visitation rights will be just one of many issues the judge will decide Monday.  Judge Cleland said he would submit his rulings in writing.

Prosecutors have also requested that Sandusky stay indoors during as part of his house arrest restrictions.

Sandusky’s house is near an elementary school, and neighbors don’t want to see him loitering outside.

"He should be forbidden to be outside his home in proximity to a school playground, where his presence alarms teachers and members of the public," Pennsylvania's attorney general said in a motion filed this week.

Another issue the judge is expected to rule on Monday is what county the jury pool will be selected from, because prosecutors have expressed concerns about a Penn State bias influencing the trial.

Centre County encompasses Penn State University and the courthouse in Bellefonte, Pennsylvania.

Prosecutors in their motion said that "the combination of the pervasive publicity and the unique nature of the Penn State community" requires that the jury be selected from another county.

More specifically, the motion says that "other, even adjacent, counties have a less intimate connection with Penn State. Recent events underscore an association between the community and University which is admirable but, ultimately, incompatible with jury service."
